Acceptance of Terms

By downloading, installing, or using the EkoWorek mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

Service Description

EkoWorek is a mobile application that allows users to order green waste collection services by:

• Authenticating through Google Sign-In
• Selecting the number of green waste bags needed (1-9)
• Providing collection address information
• Automatically sending collection requests via email to designated recipients

User Eligibility

• You must be at least 18 years old to use this App
• You must have a valid Google account for authentication
• You must have the legal capacity to enter into binding agreements
• You must be located in a jurisdiction where green waste collection services are available

User Obligations

Accurate Information

• Provide accurate and complete address information for waste collection
• Maintain valid contact information and email addresses
• Update your information promptly when changes occur

Appropriate Use

• Use the App only for legitimate green waste collection requests
• Do not submit excessive or spam requests
• Respect the App's built-in cooldown periods and system limitations
• comply with all applicable local laws and regulations regarding waste disposal

Service Availability

• We strive to maintain App availability but do not guarantee uninterrupted service
• The App may be temporarily unavailable due to maintenance, updates, or technical issues
• Service depends on third-party services including Google authentication and email delivery
• Actual waste collection services are provided by third-party waste management companies, not by EkoWorek

Intellectual Property

• EkoWorek and all related trademarks, logos, and content are owned by CodePit sp. z o. o.
• We grant you a limited, non-exclusive, non-transferable license to use the App for personal use
• You may not copy, modify, distribute, reverse engineer, or create derivative works from the App
• This license terminates automatically if you breach these Terms

Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

Disclaimers

Service "As Is"

The App is provided "as is" and "as available" without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Third-Party Services

We are not responsible for the quality, availability, or performance of actual waste collection services provided by third-party companies. Collection requests are facilitated through email communication only.

Limitation of Liability

To the fullest extent permitted by law, CodePit sp. z o. o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Delays or failures in waste collection services
• Email delivery failures or communication issues
• Loss of data or information
• Service interruptions or technical malfunctions
• Actions or omissions of third-party service providers

Termination

• You may stop using the App at any time by uninstalling it from your device
• We may terminate or suspend your access to the App at any time, with or without cause or notice
• Termination may occur immediately upon breach of these Terms
• Provisions regarding intellectual property, disclaimers, and limitation of liability survive termination

Governing Law

These Terms are governed by and construed in accordance with the laws of Poland. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of Polish courts.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date and, when appropriate, by providing additional notice through the App or email. Continued use of the App after changes constitutes acceptance of the revised Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect. The unenforceable provision will be replaced with an enforceable provision that most closely reflects our intent.
